1.Revised Regulations for the Implementation of the Drug Administration Law of the People’s Republic of China Released

Recently, the revised Regulations for the Implementation of the Drug Administration Law of the People's Republic of China was released. The document specifies that eligible pediatric drugs and rare disease treatments will be granted market exclusivity periods of up to two years and seven years, respectively, and data for drugs containing new chemical entities will be protected for a period of up to six years. The document will take effect on May 15, 2026.

Recently, the Shanghai Municipal Commission of Science and Technology issued the Detailed Implementation Rules on the Administration of Service Agencies for Shanghai Sci-tech Innovation Vouchers. The document mainly covers the scope of eligible entities and the responsibilities of the management center, the settlement and daily operations of service agencies, the comprehensive evaluation and supporting measures for these agencies, and the adjustment and supervision thereof. The document will take effect on February 28, 2026, and remain valid through August 31, 2030.
2.Shanghai High People’s Court Releases 2025 Top Ten Typical Business-related Enforcement Cases

The Shanghai High People's Court recently released the Top Ten Typical Business-related Enforcement Cases of Shanghai Courts in 2025, along with other model enforcement cases for the same year. These cases focus on issues such as the determination of liquidated damages for delay in delivery in contract disputes, enforcement and settlement in traffic accident compensation cases, transition from enforcement proceedings to pre-reorganization and reorganization procedures, promotion of settlements through judicial auctions involving urban renewal syndicated debts totaling nearly RMB 50 billion, as well as comprehensive agreements covering lease termination, property vacating and corresponding compensation.

What considerations does China have for its work in 2026 in terms of attracting and utilizing foreign investment and in further implementing the strategies to upgrade pilot free trade zones?
A
As 2026 marks the first year of the 15th Five-Year Plan, we will act on the guiding principles of the 20th National Congress of the CPC and of all previous plenary sessions of the 20th CPC Central Committee, and implement the plans set out at the Central Economic Work Conference. We will remain firmly committed to expanding high-standard opening-up, and work to foster new strengths in attracting foreign investment. Efforts will be made to deepen the institutional reform for promoting foreign investment, bolster the “Invest in China” brand, and comprehensively and thoroughly implement the strategies to upgrade pilot free trade zones, so as to contribute to a strong start to the 15th Five-Year Plan period. Our work will focus on the following four key areas:
First, we will expand market access and fields of opening-up with a focus on the service sector. We will steadily expand independent opening-up in fields such as telecommunications, healthcare and education, promote the early rollout of pilot projects, and support foreign-funded enterprises in the service sector to extend their value chains, aiming to achieve specialized, integrated and digital-intelligent development and enhance capacity and quality of the service sector. In fields that are already open, we will ensure that foreign investors are able not only to enter the market but also to operate smoothly.
Second, we will optimize policies to support foreign investment. We will ensure the implementation of policy measures such as tax credits for overseas investors who reinvest with profits derived in China and the policies related to the Catalogue for Encouraged Industries of Foreign Investment. We will support foreign-funded enterprises in participating on an equal footing in consumption-boosting initiatives, government procurement, bidding and tendering, etc., and facilitate their long-term development and sustained operations in China.
Third, we will improve the service and supporting system for foreign investment. We will fully implement national treatment for foreign-funded enterprises, focus on their concerns, and continuously optimize services. Moreover, we will organize round-table meetings for foreign-funded enterprises, and carry out initiatives to serve and support them on an ongoing basis. We aim to turn “lists of needs” of enterprises into our “lists of services”, helping enterprises resolve their difficulties and concerns.
Fourth, we will develop diversified platforms for high-standard opening-up.We will steadily optimize and adjust the regional layout and scope of pilot free trade zones to provide broader space and platforms for pioneering and pilot reforms. We will align more closely with high-standard international economic and trade rules, and carry out institutional opening-up trials across a wider range of areas, at a deeper level and with greater intensity. Tailored support will be given to pilot free trade zones to promote integrated innovation across entire industrial chains in key emerging sectors. Furthermore, we will accelerate the comprehensive pilot and demonstration work for expanding opening-up in the service sector, effectively implement the high-quality development work plans for state-level economic and technological development zones, and continuously release the benefits of institutional innovation.

What provisions does the Regulations make to improve the systems for drug development and registration?
A
In recent years, China has continued to deepen reform of drug regulation and introduced a series of policy measures to support pharmaceutical development and innovation through multiple channels. The innovative development of the pharmaceutical industry continues to gain momentum. To further encourage drug innovation and promote high-quality development of the pharmaceutical industry, the Regulations improves the relevant systems in the following aspects:
First, it supports a clinical-value-oriented approach to drug R&D and innovation, encourages new drugs R&D, and supports the clinical promotion and use of news drugs.
Second, it strengthens the management of drug R&D. The Regulations clarifies the procedures for the accreditation of institutions qualified to conduct non-clinical drug safety evaluation studies, refines the management requirements for clinical trials of drugs, and sets out R&D management requirements tailored to the characteristics of traditional Chinese medicines (TCM).
Third, it optimizes the review and approval procedures for drug registration. The Regulations establishes expedited registration procedures for drug marketing authorization including the breakthrough therapy designation. Furthermore, it clarifies the procedures for drug re-registration and specifies mechanisms for switching between preion and over-the-counter drugs.
Fourth, it grants market exclusivity periods to eligible pediatric drugs and rare disease treatments, and provides data protection for drugs containing new chemical substances.
Fifth, it refines the responsibilities of Marketing Authorization Holders (MAHs). The Regulations requires MAHs to establish and improve drug quality assurance system and pharmacovigilance system, comprehensively assess the impact of changes in the manufacturing process on drug quality, and conduct regular post-marketing evaluations.

What provisions does the Regulations make in terms of strengthening the administration of drug manufacturing?
A
Drug safety is of paramount importance, and drug production is a critical link in ensuring drug safety. To further regulate drug manufacturing activities and meet the development needs of the pharmaceutical industry, the Regulations improves the relevant systems in the following aspects:
First, it tightens the administration of contract manufacturing. MAHs are required to fulfill responsibilities such as supplier audits, management of changes during the manufacturing process, and release of drugs for marketing, and to exercise oversight over contract manufacturing organizations. It also specifies the circumstances under which segmented contract manufacturing of drugs may be permitted.
Second, it stipulates that for drugs marketed in China but manufactured overseas, their manufacturing activities shall comply with the relevant requirements of Chinese laws and regulations.
Third, it improves the management system for TCM manufacturing. The Regulations allows the primary processing of TCM materials at their places of origin based on their specific characteristics, and clarifies management requirements for production and sale of TCM decoction pieces and formula granules.

China’s New Mineral Resources Law: Opening a New Era of Strategic Opportunities in China’s Mining Investment for Foreign Investors

II. Breakthroughs and Diversified Pathways in the Mining Land System
2. Changes in land supply methods
Moving beyond the previous single model that relied primarily on granting land use rights, the New Mineral Resources Law allows the competent natural resources authorities to supply land for mining through various methods, including grants, leasing and capital contribution in the form of land use rights at appraised value. Mining enterprises may flexibly choose, or even combine, different methods according to the characteristics of their projects. More importantly, enterprises can not only obtain the right to use state-owned construction land but also acquire land through the listing and transfer of collectively-owned operational construction land in the market. This broadens the channels for land supply.
This reform fully takes into account the unique attribute of mining land whereby “land use follows the ore” and addresses the predicament in which mining development was hindered by the inability to obtain land-use rights. With regard to strategic mineral resources, the New Mineral Resources Law makes special institutional arrangements, explicitly providing that where the exploitation of such minerals genuinely requires the use of land collectively owned by farmers, expropriation may be carried out in accordance with the law.
3. Breakthroughs in temporary land use
Building upon the existing system for temporary land use in mineral exploration, the New Mineral Resources Law innovatively allows for the temporary use of land for the open-pit mining of strategic mineral resources. Where scientific analysis confirms that conditions are met for concurrent mining and reclamation, temporary use of land may be permitted upon approval by the competent natural resources authority of the people’s government at or above the provincial level. Where agricultural land is used, planting conditions must be restored.
This approach meets the needs of open-pit mining projects, which typically have shorter construction cycles and more flexible land use requirements, while ensuring ecological security through stringent approval and reclamation requirements.

1.Syngenta Group’s Global Crop Protection China Innovation Centre Breaks Ground in Jinshan

Syngenta Group broke ground on its China crop protection innovation center in Jinshan district on Jan 25. The project is scheduled to complete construction in 2027 and begin operations in 2028. Once the project is completed and put into operation, the research and development team will be built up in phases to cover multiple specialized directions such as chemical research, biological agents, bioscience, as well as product technology and engineering.
